Latest news on Schedule 1 and other guidance

In last month's Governance Today we announced that Schedule 1 will go.  As yet we do not exactly know what will be replacing it, because the Tenant Services Authority (TSA) have not yet published  for consultation it's proposals for replacement yet.  But something will happen by April!

The new framework document states the presumption that Schedule 1 and all other Housing Corporation Guidance will not form part of the new Co-regulatory system. The Housing Corporation issued over time, a number of documents that set out regulatory requirements, including circulars or guidance and good practice for housing associations, on issues such as rents, payments and benefits (related to paragraph 2, Schedule 1 of the Housing Act 1996), treasury management, and tenant involvement and accountability.


Yvonne Atkinson, director at the Board Development Agency says:

"These documents do not have any status within the TSA's new powers under the Housing and Regeneration Act 2008, unless referenced in a particular standard or code of practice. In some cases the requirements of the standards deal with the issues. In others, particular circulars relevant to the operation of the new regulatory framework have been referenced, for example when it comes to rents."

The TSA intends to work with you over the feedback period to assess whether there are any critical issues contained in any of the other circulars or other documents that ought to be incorporated in the new regulatory framework. It starts from the presumption that they will not.

Yvonne Atkinson adds:

"Earlier last year I received the following  words from Claire Miller of the TSA, in response to these questions:"

1. What is the legal and regulatory status of the old Schedule I regime ? Is it still required by the TSA to be followed is for the time being?

The 1996 Housing Act including  Schedule 1 is still in force; and the TSA is required to follow it for the time being, until the full suite of  its new powers under the Housing and Regeneration Act 2008 are commenced from 1 April 2010.

2. When will the new code be published for consultation

At this stage we are consulting on the draft regulatory regime, our discussion document was published in June with responses due by 8 September. We have yet to decide what, if anything should replace the provisions of Schedule 1. One option might be a code of practice, there is certainly provision for this with the act. Another option is not to replicate the provisions but to expect Boards to manage probity issues and to adopt ways of working which manages conflicts as they arise.
